In the face of IndiGo's trademark complaint, Mahindra renames its electric vehicle and declares it would fight the brand's rights in court.

After IndiGo had worries about the name of their electric SUV, BE 6e, Mahindra declared it will contest the brand rights of "6E" in court. Mahindra explained that there is no chance of confusion because their trademark application for "BE 6e" under class 12 (vehicles) is separate from IndiGo's "6E," which stands for an airline.

After being sued by aviation market leader IndiGo for using its call sign and popular brand name "6E," Mahindra and Mahindra said on Saturday that it will rename its newest electric vehicle.
 
Legal challenges between large publicly traded corporations have been uncommon in India, despite the prevalence of trademark infringement proceedings. The largest airline in India, IndiGo, filed a trademark infringement lawsuit against Mahindra in the Delhi High Court last week for using the number "6E" to identify Mahindra's newest electric car as the "BE 6e."

The carmaker has stated that it will take IndiGo to court to challenge the BE 6e's brand rights.

In response, Mahindra said that their mark is "BE 6e" rather than the stand-alone "6E."

"We think there is little chance of mistake because it is fundamentally different from IndiGo's "6E," which stands for an airline. Its distinctiveness is further highlighted by the distinctive styling. We do not perceive any conflict because our registration application is for a completely different product and industry sector," Mahindra stated in a statement.

"In fact, we would like to point out that in the past, Tata Motors had objected to InterGlobe using the IndiGo mark, given their Tata IndiGo car brand."

In a new sector and business, InterGlobe still uses the IndiGo mark.

According to the Mahindra statement, "we therefore find their objection to BE 6e to be inconsistent with their own previous conduct."

Mahindra stated that as it introduces products to the market, its top objective is to make sure that customers have a great experience. "We would not like to get distracted from our vision of popularising electric transport in India."

Additionally, we think it is impolite for two major Indian multinational corporations to fight needlessly and distractingly when we ought to be supporting one another instead.

Mahindra chose to call its new product the "BE 6" in light of this.

Despite the fact that our mark is unique and different, it does think IndiGo's claim is "baseless and if not challenged, will set an unhealthy precedent of monopolizing alpha-numeric 2-character marks."
