Senior attorney and former Attorney General of India Mukul Rohatgi today pointed out flaws in the accusations made against the Adani Group, stating that neither Gautam Adani, the group's founder and chairman, nor his nephew Sagar Adani have been charged with bribery or obstructing justice in the United States.
In order to refute false news reports about the indictment by the US Department of Justice, the senior attorney spoke to the media."I want to state right away that these are my personal legal opinions. I don't represent the Adani Group as a spokesperson. I practice law. I have appeared in a number of instances on behalf of the Adani Group. I have dealt with this indictment from the United States court. Five charges are involved. It is crucial to remember that Counts 1 and 5 are more significant than the others. However, neither Mr. Adani nor his nephew are accused in Counts 1 or 5. This is comparable to a chargesheet that imposes penalties on people for particular actions. Count 1 is against the two Adanis and some other people. It consists of one foreign individual and a few officers. The first accusation is that there is a plot to violate the (US) Foreign Corrupt Practices Act. In that, the Adanis are not named," he said.
According to Mr. Rohatgi, counts pertaining to securities and bonds include the Adanis and other individuals. "The Adanis and their officers are not identified in Count 5, which deals with obstruction of justice. Adanis and other parties will react to this chargesheet any they see fit, including to stock markets. After reviewing this chargesheet, these are my personal opinions," he stated.
Then, Mr. Rohatgi brought up a "troubling" aspect of the indictment sheet.
"A chargesheet needs to be explicit when stating that a given person has bribed certain people or committed a certain behavior. However, I cannot locate any information on the chargesheet regarding who was bribed, how, or to what department. There is absolutely no sound on this chargesheet. I'm not sure how someone can react to a chargesheet like this. However, I have no doubt that Adanis would consult with US attorneys," he stated.
"Not specific" is how Mr. Rohatgi later described the charges to NDTV. "Who was bribed, how much was paid, and whose contract it was paid for are not specified in the document. I'm not sure if they'll share.
